WITHDRAWING YOUR CONSENT TO DATA PROCESSING

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. An informal message to us by e-mail is enough. The lawfulness of the data processing carried out up to the withdrawal remains unaffected by it.

RIGHT TO OBJECT TO DATA COLLECTION IN PARTICULAR CASES AND TO DIRECT MARKETING (ART. 21 DSGVO)

Where data processing is carried out on the basis of Art. 6 Abs. 1 lit. e or f DSGVO (Datenschutz-Grundverordnung – the German designation of the EU General Data Protection Regulation, GDPR), you have the right at any time to object, on grounds arising from your particular situation, to the processing of your personal data; this also applies to profiling based on these provisions. The respective legal basis on which processing is founded can be found in this privacy policy. If you object, we will no longer process the personal data concerned, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims (objection under Art. 21 Abs. 1 DSGVO).

If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling in so far as it is connected with such direct marketing. If you object, your personal data will no longer be used for direct marketing purposes (objection under Art. 21 Abs. 2 DSGVO).

RIGHT TO LODGE A COMPLAINT WITH THE COMPETENT SUPERVISORY AUTHORITY

In the event of infringements of the DSGVO, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged infringement. This right exists without prejudice to any other administrative or judicial remedy.

As our registered office is in Baden-Württemberg, the competent authority for us is the Landesbeauftragter für den Datenschutz und die Informationsfreiheit Baden-Württemberg (the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg).

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done where it is technically feasible.

RIGHT TO RESTRICTION OF PROCESSING

You have the right to request that the processing of your personal data be restricted. You can contact us about this at any time at the address given in the legal notice (Impressum). The right to restriction of processing exists in the following cases:

• If you dispute the accuracy of the personal data we hold about you, we usually need time to verify this. For the duration of that check you have the right to request that the processing of your personal data be restricted.
• If the processing of your personal data was or is unlawful, you may request the restriction of the processing instead of erasure.
• If we no longer need your personal data but you need it in order to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
• If you have lodged an objection under Art. 21 Abs. 1 DSGVO, your interests and ours have to be weighed against each other. For as long as it has not been established whose interests prevail, you have the right to request that the processing of your personal data be restricted.

If you have restricted the processing of your personal data, that data may – apart from being stored – only be processed with your consent, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

COOKIES

These web pages partly use so-called cookies. Cookies do no damage to your computer and contain no viruses. Cookies serve to make our offering more user-friendly, more effective and safer. Cookies are small text files that are placed on your computer and stored by your browser.

Most of the cookies we use are so-called "session cookies". They are deleted automatically at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies allow us to recognise your browser on your next visit.

The website operator has a legitimate interest in storing cookies in order to provide its services in a technically error-free and optimised way. SERVER LOG FILES

The provider of these pages automatically collects and stores information in so-called server log files, which your browser transmits to us automatically. These are:

• Browser type and browser version
• operating system used
• referrer URL
• host name of the accessing computer
• time of the server request
• IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6 Abs. 1 lit. f DSGVO. The website operator has a legitimate interest in presenting its website without technical errors and in optimising it – and the server log files have to be recorded for that.

CONTACT FORM

If you send us a message via the contact form on this website, we process the data you enter there in order to handle and answer your enquiry. We collect:

• the type of enquiry (“Notify me”, “Celebration / group” or “Question”)
• your name and e-mail address (required, so that we can reply to you)
• your phone number, preferred date and number of guests (optional)
• your message

The legal basis is your consent under Art. 6 Abs. 1 lit. a DSGVO, which you give via the tick box in the form; if your enquiry is aimed at concluding or preparing a contract (e.g. a celebration), Art. 6 Abs. 1 lit. b DSGVO applies in addition. You can withdraw your consent at any time by informal e-mail – the lawfulness of the processing carried out up to that point remains unaffected.

To send the messages from the form we use the e-mail service Resend (Resend, Inc., USA) as a processor. The transfer takes place on the basis of the EU standard contractual clauses. Your details are processed solely in order to deliver the message to our mailbox.

To protect against automated spam, the form contains a field that is invisible to you and is only filled in by programs, together with a short-term limit on the number of enquiries per IP address. No third-party services are used to analyse your behaviour.

If you found us through an ad or a search engine, then when you send the form we read from your browser's address bar which campaign that was, and pass this detail to our inbox along with your enquiry. We store nothing on your device for this and set no cookie; if you leave our home page in between, the detail is lost and your enquiry reaches us without it. The legal basis is our legitimate interest under Art. 6(1)(f) GDPR in recognising which advertising is worthwhile. You may object to this processing under Art. 21 GDPR.

We keep your enquiry until it has been dealt with and no statutory retention obligations stand in the way; after that we delete it. Your details are not passed on to third parties for advertising purposes.

NOTIFICATION LIST FOR THE OPENING

If you expressly choose “Notify me” in the contact form, we additionally store your e-mail address in a mailing list held by our service provider Resend. We use it solely to tell you, once, that we have opened – exactly the notification you asked for.

The legal basis is your consent under Art. 6 Abs. 1 lit. a DSGVO. The other types of enquiry in the form (“Celebration / group” and “Question”) do not result in you being added to the list.

For this purpose we store only your e-mail address, no name. Every message sent to this list contains an unsubscribe link; you can also withdraw your consent at any time by informal e-mail. Once the opening message has been sent, or once you have unsubscribed, we delete your address from the list.

The list is not used for any further advertising or for a regular newsletter; we would ask for your consent separately for that.

VERCEL WEB ANALYTICS

This website uses Vercel Web Analytics, an audience measurement service provided by Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA. The service records which pages are opened and how often, the country and type of device a visit comes from, and the address visitors reached us through.

Vercel Web Analytics sets no cookies and neither stores nor reads any information on your device. No cross-device profile is created. To tell repeat visits within one day apart, a check value is derived from details of your request — including the IP address; the IP address itself is not stored, and the check value is regenerated daily, so it cannot be traced back to you.

The legal basis is our legitimate interest under Art. 6 Abs. 1 lit. f DSGVO in understanding and improving how our website works. As no information is stored on or read from your device, no consent under § 25 TDDDG is required for this. You may object to this processing under Art. 21 DSGVO; how to do so is described above under “Right to object to data collection in particular cases and to direct marketing”.

Repeat visits (only with your consent)

If you agreed in the notice banner, we additionally store a counter in your browser (local storage, not a cookie in the technical sense). It contains only the date of your first visit, the date of your most recent visit and the number of days on which you have been here. No identifier is assigned and nothing that could identify you.

From your second day of visiting onwards, we report just two classifications to the statistics: which visit it is (“2”, “3”, “4” or “5+”) and how long ago your first visit was (“1-7”, “8-30” or “31+” days). The stored dates themselves never leave your device. Counting is per day, not per page opened.

The legal basis is your consent under Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TDDDG. You can withdraw it at any time via “Change cookie settings” at the foot of the page; the counter in your browser is deleted immediately when you do. Without consent this recognition does not take place — the anonymous visitor count above continues independently. If you do not return, the counter expires by itself after 180 days.

GOOGLE ADS AND CONVERSION MEASUREMENT

We advertise using Google Ads, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. If you reach this website through one of our ads, Google appends a click parameter (gclid) to the address. This lets us see whether an enquiry actually reached us after someone clicked an ad — but not who you are.

The Google tag is embedded on this website using consent mode (Consent Mode v2). For as long as you have not consented to marketing, all consent signals are set to “denied”: Google then sets no cookies and reads no information from your device. Only cookieless hits are transmitted; they contain no identifier and no profile is built from them, and advertising identifiers are additionally suppressed within them.

Only once you consent to “Marketing” in the notice banner does Google set cookies and become permitted to use your data to measure and personalise advertising. What is measured is that an enquiry was submitted through the contact form and which campaign it belongs to. The content of your message, your name and your email address are not transmitted to Google.

The legal basis is your consent under Art. 6(1)(a) GDPR and § 25(1) TDDDG. You may withdraw it at any time via “Change cookie settings” at the foot of the page. Withdrawal takes effect immediately and does not affect the lawfulness of processing carried out up to that point.

Transfer to Google LLC in the USA cannot be ruled out. Google LLC is certified under the EU-US Data Privacy Framework; by decision of 10 July 2023 the European Commission determined that an adequate level of data protection exists for transfers to certified companies.

GOOGLE MAPS

This site uses the map service Google Maps via an API. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

In order to use the features of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.

Google Maps is used in the interest of presenting our online offering attractively and making the places we name on the website easy to find. This constitutes a legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO.
